The group really seemed to appreciate the nuance in it, how there were several different perspectives because of the number of people involved and their role.

Most discussion. No rules to rely upon. Makes them think outside of their experiences. They know they have a duty to the possible victim. Not all think about a duty to the person who made the comment.

The question contained three layers involving (1) ethics, (2) professionalism, and (3) technology and innovation. In turn, it allowed the us to discuss different consequences of unfair advantage (i.e. hypothetical #1) through the capacities of several different parties to the hypothetical (i.e., Miranda, section A students, and section B students). Because of this, a more comprehensive discussion was possible.
Lastly, the hypothetical also allowed for students to think about technological competence and confidentiality on certain platforms (i.e., groupme, listserv, etc.).

The plagiarism one is too simple. the text was verbatim plagiarized. This is an important topic but needs to be developed a little more to make it harder to decide if the student improperly copied another's work.

How could the professionalism orientation be improved?

The hypotheticals largely focused on law school issues, I would like to see another hypothetical related to practicing law. Also, another 15 minutes in the group breakout sessions would help ensure discussions are not rushed.

I think they should have at least one hypo that gives that shows them what professionalism challenges attorneys face. They are going to school to be attorneys. They should see that. The current hypos certainly prepare them to act as professionals as students. I do not think they current hypos prepare them to act as professionals when they become attorneys.

This was a great experience and I hope to do it again next year. It might also be useful for 3L's to get their own program in spring semester before graduation to start thinking about issues that will be coming their way once they start practicing law.

More time for the breakout sessions to discuss hypotheticals, 10 minutes is not enough for everyone to weigh in on every hypothetical. This year, we got a core group who really wanted to talk about every hypo and a larger group who were content to keep quiet. I think there are useful to also give the students a little taste of what their actual classes will be like.

It would further the goals of the committee to incorporate some of the varying levels of discipline that can be taken in response to certain conduct (i.e., consequences for unethical conduct vs consequences for unprofessional conduct).
