Introduction
Forced labor is a topic of great focus in the United States. Section 307 of the Tariff Act of 1930 prohibits goods made in whole or in part with forced labor from entering the United States. The Uyghur Forced Labor Prevention Act (UFLPA) was the U.S. response to the Chinese government’s systemic use of forced labor against Uyghurs and other ethnic minorities in the Xinjiang Uyghur Autonomous Region, or XUAR, in the People’s Republic of China. The law, signed into effect in December of 2021, created a presumption that all goods produced entirely or in part in the XUAR were produced with forced labor, and therefore prohibited from entry into the USA. This presumption is subject to rebuttal by the importer, but only if the importer can conclusively prove that no forced labor was used in any part of the production of the goods in question.
