The Constitution looks to what someone thinks was the "intent" of the framers' language and expands and interprets the language extensively to meet current standards of human conduct and complexity of society.

* 3. Judges should refrain from "legislating from the bench." The translation of public policy into law and the creation, extension, modification or limitation of citizens' rights (and governmental authority) are properly within the provinces of the legislative, not judicial branch of government.
