WA Guardianship Laws – Carer Survey |
Carers WA is conducting this survey to gather feedback from carers/former carers to inform its policy submission in response to the consultation on the review of the Guardianship and Administration Act 1990 (WA) (the Act).
A carer is someone who provides unpaid care or assistance to a person with disability, chronic illness, mental ill health, substance dependency, or who is frail. A person is not a carer if the care they provide is done so under a work or volunteer contract.
Respondents to this survey will have the opportunity to go into a draw to win one of two $50 Prezzie gift vouchers.
Please note: information provided through this survey will be deidentified and utilised in Carers WA’s advocacy work.
Background
In April 2024, the WA Attorney General directed the WA Law Reform Commission to review the Guardianship and Administration Act 1990 (WA). This process will include the review, provision of advice and recommendations for consideration by State Government on new legislation to enhance and update the Act. This review is called Project 114.
The current Guardianship and Administration Act 1990 (WA) provides for:
· the guardianship of adults who need assistance in their personal affairs,
· the administration of the estates of persons who need assistance in their financial affairs.
· the State Administrative Tribunal’s jurisdiction regarding guardianship and administration matters:
- to provide for the appointment of a public officer with certain functions relative thereto, to provide for enduring powers of attorney, enduring powers of guardianship and advance health directives, and for connected purposes.
Two discussion papers will be released as part of the review. Consultation on these discussion papers will be open until Friday 16th May, 2025.
