The employee undertakes, without prejudice to any general duty of confidentiality, not to disclose during the continuance of the employment contract or afterwards, any trade secrets of Hypercheck (PTY) LTD or any information, which is confidential to the business, which includes, but is not limited to:

ii.                   Supplier information

iii.                 Product list and performance

iv.                 Project information

v.                   Committee discussions

vi.                 Trade secrets and other financial information

vii.                All Staff Information

viii.              Turnover or Profitability

ix.                  Any recipes, costings and contracts

* 6. It is imperative that the work which you undertake remains confidential and is not divulged to any third party. This requirement is also extended towards any Company information which you acquire during the course of your employment with the Hypercheck Group.

The employee further undertakes immediately after termination of his or her services to hand over to Hypercheck (PTY)LTD all documentation and data in his or her possession belonging to the Hypercheck (PTY)LTD whether hard copy, contained on computer disc or any other recording medium, including documents made by him or her in the course of fulfilling his or her contractual obligations. The aforementioned implies that any copy, abstract, or any précis of any document belonging to Hypercheck (PTY)LTD shall itself belong to Hypercheck (PTY)LTD.

* 8. Hypercheck (PTY) LTD will view the disregarding of these provisions in an extremely serious light, in which regard the Company's rights remain fully reserved to take civil action against you.

It is imperative that you be aware that should you disclose any information to any party (other employees, suppliers, or any external party) or be in possession of such information, the business reserves it right to institute legal action against you. The business may seek punitive damages from you as well as pursue a criminal charge.
