Consultation: To gain views on a proposal to create pathways to authorise Chartered Legal Executives with stand-alone litigation practice rights |

CILEx Regulation (CRL) is the independent regulator for Chartered Legal Executives (Fellows), other grades of CILEX membership, CILEx Practitioners and firms.

Current situation
CRL currently awards litigation practice rights only to applicants who are also seeking advocacy practice rights. These are available in the following areas:
· Dispute resolution (civil litigation)
· Criminal litigation
· Family litigation.
Proposed changes
CRL proposes to retain the current approval routes under both the legacy education standards and the new education standards but remove the requirements relating to advocacy.
Existing chartered legal executives would be able to apply for litigation practice rights through the submission of a portfolio containing a minimum of 3 cases of litigation they have participated in OR successfully complete a training and assessment programme conducted by The University of Law on behalf of CRL.
New applicants could apply for litigation practice rights under the new education standards by submission of a portfolio of evidence against the 6 competencies as specified in the Specialist Pathway handbooks AND submission of a portfolio of 5 cases of litigation they have participated in.
Once approved, the authorised title will be one of the following dependent on the specialist pathway undertaken by the applicant:
Legacy education standards
· CILEX Litigator (Civil Litigation)
· CILEX Litigator (Criminal Litigation)
· CILEX Litigator (Family Litigation).
New education standards
· Chartered Legal Executive Litigator (Civil Litigation)
· Chartered Legal Executive Litigator (Criminal Litigation)
· Chartered Legal Executive Litigator (Family Litigation).
The Rights to Conduct Litigation exercisable by a person holding a Litigation Certificate are:
· Rights to Conduct Litigation (Civil Proceedings) Certificate – To conduct litigation in all civil proceedings excluding family proceedings
· Rights to Conduct Litigation (Criminal Proceedings) Certificate – To conduct litigation in all criminal proceedings
· Rights to Conduct Litigation (Family Proceedings) Certificate – To conduct litigation in all family proceedings.
The consultation will run for 8 weeks, from 26 March 2025, closing at 4pm on 21 May 2025.
This consultation will be of interest to members of CRL's regulated community and other stakeholders including approved regulators and consumers of legal services.
